'Dignity Denied: LGBT Immigrants in U.S. Immigration Detention'

Lesbian, gay, bisexual, and transgender immigrants face a higher risk of mistreatment in immigration detention facilities than other detainees, a report from the Center for American Progress finds. Based on Freedom of Information Act requests and complaints filed by immigrant rights groups, the report, Dignity Denied: LGBT Immigrants in U.S. Immigration Detention (28 pages, PDF), reveals the systemic nature of the abuse of LGBT detainees — among them asylum seekers and survivors of torture — including incidents of sexual assault, denial of adequate medical care, long-term solitary confinement, discrimination and abuse, and ineffective appeals processes. Recommendations in the report to address the issue include increasing the use of alternatives to detention such as electronic monitoring and supervised-release programs; codifying U.S. Immigration and Custom Enforcement's Performance-Based National Detention Standards and making them mandatory in all immigration detention facilities; ensuring access to counsel for immigrants in removal proceedings; and restoring discretion to immigration judges.
